Terms of Use – Patches Passport to the Community™ Game Card Advertising Program

Welcome to the Patches Passport to the Community™ Game Card Program by Patches Advertising & Marketing. This Terms of Use Agreement ("Agreement") governs your participation as a business participant ("Passport Professional" or "Passport Pro") in our community engagement campaign.

By purchasing a spot on the Patches Passport to the Community™ Game Card or participating in the Passport Card Program, you agree to the following terms:

1. Program Purpose

The Passport Card Program is designed to highlight and bring foot-traffic into local small businesses through a community-centered "set collection" style promotion. Customers visit participating businesses to collect stamps, that equate to entries in the drawing, while businesses receive increased visibility and in-person traffic.

2. Business Eligibility

To participate:

• Your business must be located in or serve the designated playing zone.

• You must be operating legally with all necessary local licenses or permits.

• We reserve the right to refuse listings that conflict with our brand or values.

3. Use of Business Information

By joining, you give permission for: 

• The display of your business name, logo, address, and promotional offers on printed or digital campaign materials.

• Public mention across our websites, emails, and social media.

Businesses are responsible for ensuring all submitted business information is accurate and up-to-date.

4. Advertising Placement & Duration

• Each business will appear on one or more Passport Cards depending on the package purchased.

• Placement is subject to card layout and balance across industries.

• Each campaign runs for a defined timeframe and geographic area. Dates and durations vary by zone.

5. Payment, Cancellations & Refunds

• All payments are due in full at time of purchase, unless otherwise noted.

• A prorated refund may be offered once artwork is submitted or the campaign design is finalized but has not gone to print.

• Once the design has gone to the printer, no refunds or exchanges will be issued.

• In the event a campaign is canceled by us, a credit for future use will be issued.

6. Participating Passport Pro Expectations

All participating businesses agree to:

• Greet and validate game cards for players.

• Provide any offered promotions or specials advertised during the campaign.

• Maintain active business hours during campaign dates unless otherwise arranged.

• Inform us immediately of any closures, changes in hours, or address updates.

Failure to meet these expectations may result in removal from the campaign without refund.

7. Content & Community Standards

• Listings must be family-friendly and appropriate for a general audience.

• No hateful, discriminatory, explicit, or misleading content will be accepted.

• We reserve the right to edit or remove any content that violates our brand values.

8. Program Changes

We may:

• Adjust the game mechanics, card layout, or campaign structure

• Limit industry categories (e.g., only one coffee shop per card)

• Pause or close participation windows for operational reasons

9. No Guarantee of Outcome

Participation in the Patches Passport Game does not guarantee:

• Any specific number of visitors, leads, or sales

• Cardholder engagement 

• Ongoing placement in future campaigns

You understand results may vary depending on display appeal, customer interest, weather, timing, and zone traffic.

10. Liability Limitation

Patches Advertising & Marketing, and its affiliates, are not liable for:

• Business interruption

• Lost revenue or missed opportunities

• Print or digital errors

• Customer conduct

Total liability will not exceed the amount paid for your spot on the Patches Passport to the Community™ Game Card.

11. Governing Law

This Agreement is governed by the laws of the State of Idaho. Any disputes shall be resolved in the appropriate courts of Canyon County, Idaho.

12. Acceptance

By checking out, submitting payment, and confirming participation, you:

• Agree to these Terms of Use

• Confirm you are authorized to represent the business

• Acknowledge your responsibilities under this agreement
